Challenge
A mid-sized financial institution needed to restructure an existing facility into a Syariah-compliant format to satisfy new investor requirements, while preserving the commercial terms of the original arrangement.
Approach
We undertook a detailed review of the existing facility, identified the modifications required for Syariah compliance, and worked with the institution's internal Syariah board to finalise the structure before documenting the arrangement.
Outcome
The restructured facility was approved and executed within the client's required timeframe. All parties were satisfied with the final documentation and the process attracted no subsequent regulatory concerns.
Timeline: 8 weeks
Challenge
A digital news outlet received a legal notice following an investigative piece that named a public official. The client needed to understand their legal exposure and decide how to respond.
Approach
We reviewed the article, assessed the defamation risk under Malaysian law, and advised on the strength of available defences including truth and fair comment. We then drafted a response to the notice that was clear and legally grounded.
Outcome
The matter was resolved without litigation. The client was satisfied that their editorial integrity had been maintained and their legal position appropriately protected throughout.
Timeline: 3 weeks
Challenge
A small manufacturing company had accumulated debt from multiple creditors during a difficult trading period and faced winding-up petitions from two of them. The directors needed to understand their options before the petitions were heard.
Approach
We assessed the company's financial position and the viability of restructuring. We identified that a voluntary arrangement with creditors was feasible and prepared a proposal that addressed the key creditors' concerns while preserving the going-concern value of the business.
Outcome
The creditor arrangement was agreed upon and the winding-up petitions were withdrawn. The company continued trading on a reduced but sustainable basis. The directors acknowledged that they had not expected this outcome to be achievable.
